Journal, June 4, 1903 TO FIX CEMETERY, Effort Being made to Improve Old Cemetery The old cemetery on North Market street is just now attracting attention because it needs attention in more ways than one. Beyond an occasional mowing of the grass, little is done to keep the place as a cemetery should be kept. A fence is needed around the lot, and in many places the lots should be graded and the graves filled up. These improvements will all cost money, and as there is no association back of the cemetery, the expense will naturally fall on those interested by having friends or relatives buried there, and upon those interested in the welfare and appearance of the town. With the purpose of raising funds for this purpose, H.B. Sheller has headed a subscription paper, and has circulated it about town. He also asks that all living away from town having an interest in this cemetery send to him whatever contributions they are able to make. He will receipt for the same, and later show how the money has been used. This is possibly as old a cemetery as there is to be found in this part of the country. There are graves there dating back in the thirties, and many of the old pioneers who did much to pave the way for the present prosperous town and community have found their last resting place in that lot. From respect to the work that these people have done, the town should feel an interest in caring for the cemetery, and those who have relatives buried there should not be slow in assisting. Source: News-Journal, February 8, 1940 PROCEDURE BY WHICH THE BODIES IN OLD CEMETERY CAN BE MOVED Considerable interest has been taken in the proposal to move the bodies in the Old Cemetery to Oaklawn cemetery and convert the site of the Old Cemetery into a park. For the most part the public reaction has been favorable, especially from people who know the condition of the Old Cemetery, and realize that conditions will get worse in future years. Some have raised the question of who can deed this land to the town. The heirs of Edmund Holderman have this right. The land was part of the Allan Holderman estate and while it was set aside for cemetery purposes, Mr. Holderman never deeded the land to anyone. On Page 506 of Deed Record Z in the county recorder's office at Wabash, appears a deed in which Henry Holderman, Milton Bond and Lavina Bond, heirs of Allan Holderman signed a quit claim deed to Edmund Holderman, the other heir, for that part of the estate of Allan Holderman described in substance as follows: Commencing at Ninth and Market streets or the northwest corner of the southeast quarter of Section 32, Township 30, Range 7 east; thence south about 100 rods to the Jane Holderman addition, which is the north edge of the Central school ground, thence east to Sycamore street thence north to Ninth street, and thence west to the place of beginning, or 51.90 acres. These heirs of Edmund Holderman are Mrs. Ada Freeze of Wabash, Mrs. W.H. Howe of Hammond, Mrs. R.E. Little of Villa Park, Illinois, H.L. Holderman of Azusa, California. The three daughters have signified their willingness to sign a deed, and give assurance their brothers will sign. That is the first step to be taken so the town can legally ask for a WPA labor grant and labor made available to remove the bodies. The second question frequently asked is "can the town legally act". An act of 1905, which will be found on page 402, section 263, reads as follows: Sec. 263: "When any cemetery within, or in the vicinity of, the corporate limits of any city or town in this state has been or shall hereafter be conveyed to such city or town by the board of county commissioners, or when such cemetery exists wherein burials have been made by the license or permission of the owner, or owners, of the lands whereon such cemetery is located, or when any such cemetery exists, by dedication for burial purposes of the lands on which is situated, or when such city or town has in any manner come into the custody or ownership of such cemetery, or the lands on which such cemetery is located, the common council of such city or board of trustees of such town, may vacate such cemetery as hereinafter provided. "When five resident freeholders of such city or town shall, in writing, petition the common council of such city or the board of trustees of such town, to vacate such cemetery, such petition shall be entered at length in the proper record of proceedings of such common council or board of trustees. And if, on considering such petition, such common council or board of trustees, shall find that such cemetery has fallen into neglect and disuse; that remains of deceased persons have been from time to time exhumed and removed therefrom on account of such neglect, or that such cemetery hinders or obstructs the growth of such city or town, or any part thereof, or that the same is injurious to the health of the neighborhood in which it is located, such findings shall be entered at length in such record of proceedings, together with an order that such cemetery be vacated. "Such common council or board of trustees shall thereupon prepare, as nearly as may be, a complete list of the names of the deceased persons, whose bodies remain interred in such cemetery, and shall publish the same for two weeks successively, once each week in some newspaper of general circulation printed and published in the county, together with a notice to all persons interested, that on and after the time stated in such notice, (which shall not be less than sixty days after the last publication thereof) such common council or board of trustees will cause the bodies in such cemetery to be exhumed, the remains of any such persons as may be claimed by their relatives or friends, shall be delivered to such claimants, for removal and reinterment. The remains of all persons remaining unclaimed shall be removed and properly reinterred in some suitable cemetery or burial ground in the vicinity of such city or town, by and at expense of such city or town; and all monuments, gravestones, or other distinguishing marks shall be removed with such remains, and placed in proper positions. Such common council or board of trustees shall also record the proper record of this proceedings, the names as ascertained of all deceased persons reinterred, together with a description of the place of reinterment. "The title of the cemetery grounds, where the same has been or shall be conveyed by the board of commissioners of the county, to any city or town, after such cemetery shall have been vacated, shall, in no wise be disturbed thereby, and the same shall continue in and be preserved by such city or town, and such city or town, may convey the same or any part thereof in fee simple." A supplemental act in 1925, which did not repeal any of the 1905 act, gives the town authority to convert such vacated cemetery land into a park, and , if it desires, to erect a memorial shaft or marker.
